These Terms of Service apply to all consultations, proposals, and engagements with Jinello, a sole proprietorship based in Hengelo, the Netherlands. By booking a consultation or agreeing to an engagement in writing, you accept these terms.
Jinello provides AI video strategy and automation consulting services aimed at reducing no-shows and improving lead follow-up for businesses. The specific scope of work, deliverables, and timeline are confirmed in writing before any engagement begins. That written agreement takes precedence over anything else.
The initial consultation call is free and carries no obligation on either side. It is a diagnostic conversation to determine whether our services are a good fit for your situation. Jinello reserves the right to decline an engagement if we do not believe it will produce meaningful results for your business. If a client does not attend the scheduled call without prior notice, Jinello is under no obligation to reschedule.
All engagements require a payment of 50% of the agreed amount upfront before any work begins. The remaining 50% is due upon delivery of the agreed deliverables. No work starts without the upfront payment being received. Payment terms are confirmed in the written proposal.
If payment is not received within 14 days of the agreed due date, Jinello reserves the right to pause or terminate the engagement.
Each engagement includes two rounds of revisions within the agreed scope of work. A revision means feedback on delivered work that is incorporated into the existing deliverable. Changes that go beyond the original scope, or requests submitted after the revision rounds have been used, will be quoted separately and require a new agreement before work begins.
Delivery timelines are agreed upon in writing before the engagement starts. Jinello will communicate proactively if a delay is expected. Timelines may be affected if the client is late in providing required materials, feedback, or approvals. In that case, the delivery date shifts accordingly.
If the agreed system is live, all videos have been sent, and both parties can objectively confirm after 30 days that the system has not produced any results, the client is entitled to a full refund of the amount paid. The following conditions apply:
The system must have been fully implemented according to the agreed scope. The client must have provided all required materials on time, including recordings and any access needed to set up the system. The 30-day period must have passed with the system actively running. Jinello determines, based on available data, whether these conditions have been met. The guarantee does not apply if the client has interfered with, paused, or altered the system during the 30-day period.
In the event that Jinello is unable to complete the agreed work due to circumstances on our end, the client will receive a refund proportional to the work not yet delivered. For example, if 50% of the work has been completed, 50% of the total amount paid will be refunded. Jinello will communicate this as soon as possible and work towards a fair resolution.
All custom assets built for your business, including video scripts, automation workflows, and related materials, become your property once the engagement is complete and full payment has been received. Until that point, all work remains the property of Jinello.
Jinello retains the right to reference the type of engagement in its own marketing without identifying you or your business, unless you give explicit written permission to do so.
Jinello treats all business information shared during an engagement as confidential. We do not share client details, strategies, or data with third parties without your written consent.
Jinello is not liable for indirect or consequential losses, including but not limited to lost revenue, missed opportunities, or reputational damage. Our total liability in any situation is limited to the total amount paid for the specific engagement in question.
Results from our services depend in part on factors outside Jinello's control, including but not limited to the quality of the client's existing lead flow, their responsiveness during the engagement, and market conditions.
These Terms are governed by Dutch law. Any disputes arising from an engagement with Jinello will be subject to the jurisdiction of the competent court in the Netherlands.
Jinello may update these Terms from time to time. The most recent version will always be available on this page. The Terms in effect at the time of a written agreement apply to that engagement.
